What the Service Is, and Is Not Fohrkast provides software and general compliance information. It is **not** a law firm and does not provide legal services or legal advice. Generated documents are standard templates with version numbers and source citations. The AI used to fill them produces general information only. You remain responsible as the data controller for any materials you publish, and should obtain independent legal advice for your specific circumstances. ## 2. Plans, Billing, and Renewal - The Service has a free plan and paid plans (currently Starter, Pro, Business, and Nonprofit), plus one-time purchases. Paid plan prices are shown on the pricing page and exclude VAT, which is added at checkout where applicable. - Paid subscription plans are billed monthly or annually as chosen at checkout and renew automatically for the same period until cancelled. One-time purchases do not renew. - You can cancel a subscription at any time in Billing > Manage subscription. - Access continues until the end of the paid period and is not pro-rated. ## 3. Right of Withdrawal (Consumers) If you buy as a consumer, you normally have a 14-day right to withdraw from a distance contract under consumer protection law. Because the Service is supplied immediately on your express request, **at checkout you expressly request that performance begins now. If you withdraw within the 14 days you pay a proportionate amount for the part already supplied (CRD Article 14(4)(a)); you fully lose the right of withdrawal only once the Service has been fully performed (Article 16(a)).** You can still cancel future renewals at any time. ### Withdrawing Before Performance Begins To withdraw before performance starts, use this model form: > To: the Service Operator (see Company Information). Acceptable Use - Use the Service only for your own websites and businesses, or those you are authorised to act for. Do not scan or claim sites you do not own or are not authorised to test. - Do not attempt to break, overload, reverse engineer, or misuse the Service or its security controls. - You are responsible for reviewing every document and scan result before you publish or rely on it. - Shield holds the non-essential trackers it detects until consent. You are responsible for placing the Fohrkast tag before all other tags and for tagging any tracker hard-coded directly in your page source; trackers loaded ahead of Shield, or not detected, are outside its control. You remain responsible for your own compliance with the ePrivacy Regulations (in Ireland, S.I. No. 336 of 2011, Reg. 5(3)) on your site. ## 5. Warranties and Disclaimer The Service, including generated documents, scan results, and AI output, is provided "as is" and "as available". It is general information, not legal advice. Fohrkast does not warrant that it is complete, accurate for your circumstances, error-free, or that using it makes you compliant with any law. You are responsible for reviewing and, where needed, taking professional advice on the materials you publish. ## 6. Limitation of Liability To the fullest extent permitted by law, and subject to Section 7, Fohrkast's total aggregate liability to you arising from or in connection with the Service and these Terms, whether in contract, tort (including negligence), or otherwise, is limited to the total fees you paid to Fohrkast for the Service in the 12 months before the event giving rise to the claim. Fohrkast is not liable for any indirect or consequential loss, loss of profits, revenue, goodwill, anticipated savings, or for any fine or penalty imposed on you. This cap is described as a reasonable allocation of risk between two businesses. ## 7. What We Do Not Exclude Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including: - Liability for death or personal injury caused by negligence - Liability for fraud or fraudulent misrepresentation - Any statutory rights you have as a consumer under the Consumer Rights Act 2022 and related legislation ## 8. Governing Law These Terms are governed by the laws of India, where the Service Operator is based. **If you are a consumer resident in the EU or EEA**, nothing in these Terms deprives you of the mandatory consumer protection rules of your country of residence. You may bring proceedings in the courts of your country of residence, and Fohrkast will bring proceedings against you only in those courts. --- ## Frequently Asked Questions **Can I use Fohrkast to scan websites I don't own?** No. You may only use the Service to scan or claim sites you own or are authorised to test. Scanning or claiming unauthorised sites breaches the acceptable use terms and triggers your indemnity obligation. **What happens if I cancel my paid plan?** Access continues until the end of your current billing period. You will not be charged for the next month. Cancellation is handled in Billing > Manage subscription. **Do I have a right to get my money back?** If you buy as a consumer, you have a 14-day withdrawal right from a distance contract. Because the Service begins immediately on your express request, if you withdraw within the 14 days you pay a proportionate amount for the part already supplied (CRD Article 14(4)(a)); you fully lose this right only once the Service has been fully performed (Article 16(a)).
